2. Eligibility and Authority to Purchase

By using our website, you confirm that:

  • You are acting with full authority and lawful right to create or request content relating to a deceased individual;
  • You will not use our services to create unlawful, defamatory, or offensive content.

If you are ordering content that features or references a deceased individual, you warrant that:

  • You have the legal right and/or necessary permissions from the next of kin, estate executor, or relevant authority to do so;
  • You accept full responsibility for any legal or ethical implications arising from the creation or publication of such content.

     

3. Products and Services

In Living Memories provides digital and physical products, including but not limited to:

  • Tribute pages or memorial content;
  • Printed memory books or keepsakes;
  • Custom video/audio tributes.

All products are created based on the information provided by you. You are solely responsible for the accuracy and legality of all submitted content.

4. Ordering Process

To place an order:

  • Add your chosen products to the cart and proceed to checkout.
  • Submit all necessary personalisation and content.
  • Complete payment through our secure gateway.

     

We reserve the right to decline or cancel orders that breach these Terms or UK law.

5. Pricing and Payment

All prices are in GBP (£) and include applicable UK VAT, unless otherwise stated. Payment is due in full at the time of order unless otherwise agreed in writing.

We use third-party payment processors and are not liable for any issues arising from their services.

6. Delivery

Estimated delivery times are provided at checkout. We are not responsible for delays caused by postal services or circumstances beyond our control.

Digital content will be delivered via email or online download.

7. Cancellations and Refunds

Under the Consumer Contracts Regulations 2013, you may have a right to cancel your order within 14 days if the goods or services have not been personalised or delivered.

However, you will not have the right to cancel:

  • Once we have started creating custom or personalised content;
  • If the digital content has been downloaded or accessed.

     

If a product is defective or not as described, you may be entitled to a replacement or refund under the Consumer Rights Act 2015.

8. Intellectual Property

All original content created by In Living Memories is protected by copyright. You are granted a non-exclusive, non-transferable licence to use the content for personal and memorial purposes.

You must not reproduce, distribute, or modify any part of our content without prior written permission.

9. Content Submission and Responsibility

You confirm that any materials (text, images, audio, video) you submit:

  • Are owned by you, or you have the appropriate legal rights to use them.
  • Do not infringe on the rights of any third party.
  • Are not harmful, defamatory, or otherwise unlawful.

     

We reserve the right to remove or refuse content that breaches these conditions.

10. Limitation of Liability

We shall not be liable for:
